General Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all deliveries from KNIT KNIT / Belinda Sykora, Lisa Benischek GbR (hereinafter: KNIT KNIT) to consumers (§ 13 German Civil Code).

3. Offer and Conclusion of Contract
3.1 The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. Errors excepted.
3.2 By clicking the "Confirm Order" button, you place a binding order for the goods listed on the order page. The purchase contract is concluded when we accept your order by sending an order confirmation email immediately after receiving your order.

4. Prices and Shipping Costs
4.1 The prices stated on the product pages include statutory VAT and other price components.
4.2 In addition to the stated prices, we charge a flat rate of €5.99 per order for delivery within Germany. Shipping costs will be clearly communicated to you again on the product pages, in the shopping cart system, and on the order page.

6. Delivery
6.1 Delivery within Germany will take place within up to 5 business days after receipt of payment in our account. We will indicate any differing delivery times on the respective product page.

7. Payment
7.1 Payment can be made either in advance, via PayPal, or by direct debit.
7.2 If you choose advance payment, we will provide you with our bank details in the order confirmation and deliver the goods after receipt of payment.
7.3 You are only entitled to offset claims if your counterclaims have been legally established by a court, are undisputed, or have been acknowledged by us in writing.
7.4 You can only exercise a right of retention insofar as the claims arise from the same contractual relationship.

8. Retention of Title
8.1 The goods remain our property until full payment has been made.

Ordering Process
Once you have found the desired product, you can place it non-bindingly in the shopping cart by clicking the respective button. You always have access to your shopping cart and can add and remove products as you wish. If you want to purchase the products in the shopping cart, complete the purchase process. After entering your data and selecting the payment method, you will be taken to the order page again to review your entries. By clicking the "Confirm Order" button, you complete the order process. The process can be canceled at any time by closing the browser window. On the individual pages, you will receive further information, e.g., regarding correction options.

The contract text is stored on our internal systems. You can view the General Terms and Conditions on this page at any time. The order data will be sent to you by email. After completing the order, your order data will no longer be accessible via the internet for security reasons.

Right of Withdrawal and Withdrawal Form

1.1
Consumers have a fourteen-day right of withdrawal.

Instructions on Withdrawal / Right of Withdrawal
You can withdraw your contract declaration within 14 days without giving reasons in text form (e.g., letter, fax, email) or - if the item is handed over to you before the deadline - by returning the item. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring delivery of similar goods, not before receipt of the first partial delivery) and also not before fulfillment of our information obligations according to Article 246 § 2 in conjunction with § 1 (1) and (2) EGBGB as well as our obligations according to § 312e (1) sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. Timely dispatch of the withdrawal or the item is sufficient to meet the withdrawal deadline.

Consequences of Withdrawal
In the event of an effective withdrawal, the services received by both parties must be returned and any benefits drawn (e.g., interest) surrendered. If you are unable to return the received service in whole or in part, or only in a deteriorated condition, you may have to compensate us for the loss of value. This does not apply to the surrender of items if the deterioration of the item is exclusively due to its inspection - as would have been possible for you, for example, in a retail store. Otherwise, you can avoid the obligation to compensate for a deterioration caused by the intended use of the item by not using the item as your own property and refraining from anything that could impair its value. Items that can be sent by parcel post are to be returned at our risk. You must bear the costs of the return if the delivered goods correspond to the ordered goods and if the price of the item to be returned does not exceed 40 euros, or if, at a higher price of the item at the time of withdrawal, you have not yet provided the consideration or a contractually agreed partial payment. Otherwise, the return is free of charge for you. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your declaration of withdrawal or the item, for us with its receipt.

Please avoid damage and contamination. Please return the goods to us in their original packaging with all accessories and all packaging components if possible. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging to avoid claims for damages due to inadequate packaging.

Please return the goods to us as a franked parcel and keep the proof of postage. We will also gladly reimburse you for postage costs in advance upon request, provided these are not to be borne by you yourself.

Please note that the modalities mentioned in paragraphs 1.1 to 1.2 are not a prerequisite for the effective exercise of the right of withdrawal.

We generally only accept returns if the data specified in the order has demonstrably not been implemented by us. Material structure and colors may vary slightly from the original. The products leave our premises in perfect condition.


Return costs when exercising the right of withdrawal
If you exercise your statutory right of withdrawal (see instructions on withdrawal), you must bear the regular costs of the return if the delivered goods correspond to those ordered. Otherwise, the return is free of charge for you.
